Trump’s nominee for Supreme Court, Neil Gorsuch, keeps saying Roe v. Wade is “the law of the land,” “established precedent. . .” It’s the thing to say so as to get through the confirmation hearings. Sotomeyer and Roberts used the same phrases. We take a hard look at precedent and “stare decisis,” and discover that the Supreme Court has reversed itself 140 times on cases involving the Constitution.
